1. The seller

Balela is operated by RAFAEL DA SILVA ("we", "us", the "Seller"). By creating an account or using the service, you enter into a contract with RAFAEL DA SILVA and agree to these terms. If you do not agree, do not use the service.

2. The service

Balela is an AI-powered language learning platform offering speaking, writing, pronunciation, grammar, vocabulary and reading practice. New accounts receive a 30-day free trial; after the trial, access requires a paid monthly subscription.

3. Your account

You must provide accurate information and keep it updated. You are responsible for keeping your login credentials confidential and for all activity under your account. You must be of legal age in your country, or have a parent or guardian's consent, to subscribe.

4. Acceptable use

You must not misuse the service. In particular, you must not:

use it for unlawful purposes, fraud or spam; infringe intellectual property rights; upload malware, probe or attack our systems, or scrape the service; attempt to reverse engineer, resell, redistribute or circumvent technical limits of the platform.

5. AI-generated content

The tutor's responses are generated by artificial intelligence and may be inaccurate or incomplete. They are educational aids, not professional advice. You are responsible for the content you submit, for having the rights to it, and for how you use the outputs. Do not use the AI to create illegal content, deepfakes, hate speech or malware, or to attempt to bypass its safeguards. We may remove content, filter outputs or suspend accounts that violate these rules. Rights holders may contact us to request removal of infringing content; repeated infringement leads to account termination.

6. Intellectual property

We retain all ownership of the service and its intellectual property, including software, documentation and branding. We grant you a limited, non-exclusive, non-transferable right to use the service within your plan. You keep ownership of the content you submit; you grant us a limited license to host and process it solely to provide the service.

7. Payments and subscription

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Subscriptions renew monthly until cancelled. If payment fails, your account enters a 30-day grace period and is then blocked until payment is made.

8. Service level

We work to keep Balela available and improving, but we do not guarantee uninterrupted or error-free performance. We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated or serious violations of these terms.

9. Liability

To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential or special damages (including loss of profits, data or goodwill). Our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury where the law does not allow it.

10. Termination and data

You may cancel your subscription at any time; access continues until the end of the paid period. When your account is deleted, your personal data is removed or anonymised as described in our Privacy Notice.

11. General

These terms are governed by the laws of Brazil. You may not assign this contract without our consent; we may assign it in connection with a merger or acquisition. We are not liable for delays caused by events beyond our reasonable control. We may update these terms; continued use of the service after changes means you accept them.
